Refutation to the material published in "Haykakan zhamanak" [Armenian Time] daily  2008-12-15 10:14

The Judicial Acts Compulsory Enforcement Service of the Ministry of Justice of the Republic of Armenia denies untrue information published in press, in particular in "Haykakan zhamanak" daily.

Mentioning the alienation of property and rights in rem of "Bjni Mineral Water Factory" by electronic auction, the periodical reports that the debtor has not been properly notified on the commencement of the auction. We would like to inform that the JACES has tried to submit the decision on putting the mentioned property to forced electronic auction to Saribek Sukiassyan, the founder of "Bjni Mineral Water Factory" CJSC, and Ara Zohrabyan, person authorised to represent the interests of the company.  But getting acquainted with the decision, they have openly refused to receive it, and a relevant protocol has been drawn up thereon.  Besides, the decision was sent by registered letter to the parties, i.e. the founders, the director of the company and the authorised person.  By the way, we should note that the director of the company was not available in the factory and unreachable by mobile phone.

As to the statement of the author of the article, that the JACES has breached the requirements of Article 30 of the Law of the Republic of Armenia «On public bids" and that the parties must be notified on the commencement of the auction 24 days prior to it, it is merely a result of having no proper knowledge of the laws. "Bjni Mineral Water Factory" CJSC was not put to forced auction, but to forced electronic auction, the procedure for the organisation and holding whereof is prescribed by Articles 35.1-35.4. According to them, "the decision of the compulsory enforcement officer on holding forced electronic auction shall be sent to the debtor and the creditor at least ten days prior to the publication of the notification". The mentioned rule of the law has been complied with.  

The JACES once again calls upon mass media to refrain from publication of unverified information and urges the journalists to use the explanations of the Service for publishing legally correct materials.
